Partnership Dispute – Punitive Damages

Our client was a partner in a commercial office development.  After several years of operation, it became apparent that our client’s partner, the Defendant, had been making inappropriate use of partnership funds and mismanaging the property.  

We obtained a preliminary Court Order to sell the property and have the funds held in trust until the matter went to trial.  The Court of King’s Bench trial justice awarded judgment in full to our client, the Plaintiff: judgment for lost profits, recovery of excess draws by the Defendant, and punitive damages for the Defendant’s misconduct.
